What Is a Well-Known Trademark?
Under Section 2(1)(zg) of the Trade Marks Act, 1999, a "well-known trademark" is one that:
- Has become well known to a substantial segment of the public in India
- The use of that mark in relation to any goods or services would be likely to be taken as indicating a connection with the owner of the well-known trademark
The critical benefit: well-known marks get cross-class protection. A regular trademark only protects you in the classes you are registered in. A well-known trademark protects you against confusingly similar marks in any class — even classes completely unrelated to your business.
Criteria for Well-Known Trademark Status in India
IP India considers multiple factors when determining well-known status. These are set out in Section 11(6)–11(9) of the Trade Marks Act:
